When
someone engage’s a solicitor in a litigation
case how then does the relationship between solicitor
and client proceed?
In litigation cases, when a client instructs us at Lynch
and Partners, we will ask the client to sign an AUTHORITY & RETAINER,
which irrevocably authorises and directs Lynch and Partners
to:
1. act as your solicitors in the prosecution of the action.
2. arrange, if necessary, a loan to fund the outlay incurred
in processing the case.
3. pay off the loan out of the net proceeds of the any
settlement/award or lodge the net proceeds of the settlement/award
and irrevocably authorise (if we cease to act as your
solicitors you will release us from this undertaking)
4. give any necessary undertakings in relation to the
recovery.
5. deduct from any settlement or award monies due as
a result of:
- any
shortfall in our fees over the amount recovered
from the other party together with V.A.T.
- any
expenses or outlays payable which are not paid by
the other party
